Terms of Service

Please read these Terms of Service ("Terms") carefully before using the MonadNoc platform operated by MonadNoc ("we", "us", "our").

1. Acceptance of Terms

By accessing or using our platform, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the service.

2. Service Description

MonadNoc provides a website building and hosting platform that allows users to create, customize, and manage websites for their businesses, including but not limited to:

  • Website templates and customization tools
  • Content management systems
  • Payment processing integration
  • Customer booking and scheduling
  • Email marketing and newsletter management
  • Analytics and reporting tools

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating an account
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4. Customer Obligations

As a customer using our platform, you agree that:

  • You are the Data Controller for all personal data collected through your website
  • You will provide a Privacy Policy to your website visitors
  • You will obtain proper consent before collecting personal data from your users
  • You will comply with all applicable data protection laws (GDPR, CCPA, etc.)
  • You will handle data subject requests from your users in a timely manner
  • You will not collect data you do not have a lawful basis to collect
  • You will not use the platform for illegal or unauthorized purposes
  • You will not violate any laws in your jurisdiction or the jurisdiction of your users

5. Data Processing Agreement

5.1 Our Role as Data Processor

MonadNoc acts as a Data Processor for personal data collected and stored through customer websites. As a Data Processor, we:

  • Process personal data only as instructed by you (the Data Controller)
  • Implement appropriate technical and organizational measures to ensure data security
  • Store data securely using industry-standard encryption and access controls
  • Comply with applicable data protection laws and regulations
  • Assist you with data subject requests when reasonably possible
  • Notify you promptly of any data breaches affecting your data
  • Maintain records of processing activities as required by law

5.2 Data Security

We implement appropriate security measures to protect personal data against unauthorized access, alteration, disclosure, or destruction, including:

  • Encryption of data in transit and at rest
  • Regular security audits and vulnerability assessments
  • Access controls and authentication mechanisms
  • Secure data centers with physical security measures
  • Regular backups and disaster recovery procedures

5.3 Data Retention

We retain personal data for as long as necessary to provide our services or as required by law. Upon termination of your account, we will:

  • Delete or anonymize your data within 30 days of account termination
  • Retain certain data as required by law or for legitimate business purposes
  • Provide you with a copy of your data upon request before deletion

5.4 Sub-Processors

We may use third-party service providers (Sub-Processors) to process personal data on our behalf. Current Sub-Processors include:

  • Supabase - Database and authentication services
  • Stripe - Payment processing
  • Vercel - Hosting and CDN services

We ensure all Sub-Processors maintain appropriate data protection standards and are bound by contractual obligations to protect your data.

5.5 International Data Transfers

Your data may be processed and stored in countries outside your jurisdiction. We ensure appropriate safeguards are in place for international data transfers, including:

  • Standard Contractual Clauses (SCCs) where applicable
  • Compliance with GDPR requirements for international transfers
  • Data processing agreements with all Sub-Processors

5.6 Your Responsibilities as Data Controller

As the Data Controller, you are responsible for:

  • Determining the lawful basis for processing personal data
  • Obtaining proper consent from data subjects where required
  • Providing clear privacy notices to your users
  • Handling data subject requests (access, deletion, portability, etc.)
  • Ensuring data collection is limited to what is necessary
  • Implementing appropriate data retention policies
  • Notifying relevant authorities of data breaches affecting your users
  • Complying with all applicable data protection laws in your jurisdiction

We provide tools and templates to assist you, but ultimate responsibility for legal compliance rests with you as the Data Controller.

6. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. You agree to pay all fees associated with your subscription plan. All payments are processed securely through Stripe. Refunds are handled according to our refund policy.

7. Intellectual Property

The platform and its original content, features, and functionality are owned by MonadNoc and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of all content you create and upload to the platform.

8. Prohibited Uses

You agree not to use the platform to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any malicious code or viruses
  • Spam or harass other users
  • Collect data without proper consent or lawful basis
  • Use the platform for any illegal or unauthorized purpose

9. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the platform will cease immediately.

10. Limitation of Liability

To the maximum extent permitted by law, MonadNoc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the platform after such changes constitutes acceptance of the new Terms.
